Pet food supplier Seeds Taiwan decided not to allow its downstream online sellers to determine their own pet food retail prices while the company had no justifiable causes such as to promote competition. The practice was in violation of Article 19 (1) of the Fair Trade Act. The FTC imposed an administrative fine of NT$300,000 on the company.
2. JPD Co., Ltd. Taiwan Branch, a multi-level marketing business, violated Article 7 (1) of the Multi-level Marketing Supervision Act by changing its product items without filing with the FTC in advance. The FTC imposed an administrative fine of NT$50,000 on the company.
3. Mannateh Taiwan, a multi-level marketing business, violated Article 7 (1) of the Multi-level Marketing Supervision Act by changing its product items and sales system without filing with the FTC in advance. The FTC imposed an administrative fine of NT$100,000 on the company.
4. When marketing the “Fu Yu Wen Hui (transliteration)” housing project, Sheng Yu (transliteration) Construction Co., Ltd. and LTPA Real Estate Co., Ltd. marked the balcony areas as part of the interior space on the “B5 (A3) floor plan” and the “B3 (A5) floor plan” displayed in an advertisement. The practice was a false and misleading representation with regard to content and use of product and could also affect transaction decisions in violation of Article 21 (1) of the Fair Trade Act. The FTC imposed administrative fines of NT$1.2 million and NT$400,000 on the two companies, respectively.
5. Hsin Tang Cheng Cable Co., Ltd. presented its HD99 high definition package service in the form of a “payment slip” in an advertisement and, moreover, the content did not disclose the restrictions on the use of gift items. The practice was a false and misleading representation in violation of Paragraph 4 of Article 21 of the Fair Trade Act and Paragraph 1 of the same article was applicable mutatis mutandis. The FTC imposed an administrative fine of NT$50,000 on the company.
