2.Understanding Tendencies in Advance to Perfect Complementary Regulations
(1) Building a quality environment for competition in the digital economy
In response to the development of the digital economy, the Commission released its White Paper on Competition Policy in the Digital Economy on Dec. 20, 2022. The publication was a comprehensive exploration of competition issues derived from the digital economy. The unusual report pointed out corresponding enforcement standpoints and policy directions. It was well received in all sectors. Furthermore, the summarized version in English not only won recognition across the globe but also received a 2024 Antitrust Writing Award organized by Concurrences, an internationally renowned antitrust publisher.
The White Paper started from the four major perspectives of “platforms being mediums of transaction,” “data being resources sought after,” “cross-disciplinary approaches being a path to growth” and “market power concentration being a tendency in competition” as it discussed the preferences of platform operators, most favored customer clauses, online marketing channel restrictions, killer acquisitions, algorithms and 14 other competition issues. In the conclusions and suggestions, regulations to be promoted or revised in the long term and in the short term and the cultivation of enforcement attitude and capability in response to the peculiarities of the digital economy were recommended.
