  1. When recruiting franchisees for the Seven Tea chain, Seven Tea Co., Ltd. did not provide prospective franchisees with four important types of franchise information before contract signature. The practice was obviously unfair conduct able to affect trading order in violation of Article 25 of the Fair Trade Act. The FTC imposed an administrative fine of NT$200,000 on the company.
  2. TFN Media Co., Ltd. and KBRO Co., Ltd. failed to fulfill the fifth and eighth undertakings specified in the FTC’s Kung-Jie-Tzu Merger Decision No. 099004 dated Oct. 29, 2010. The condition complied with the violation pattern described in Article 39 (1) of the Fair Trade Act. In addition to imposing an administrative fine of NT$50 million on each company, the FTC also ordered both of them to correct their joint management practices.
  3. By establishing a reference price list for its members, Yilan County Heavy Equipment Operators Association restricted the business activity of the members and the practice had an effect on the supply-demand function in the relevant market. The conduct was a concerted action forbidden in Article 15 (1) of the Fair Trade Act. The FTC ordered the association to cease the unlawful act and also imposed on it an administrative fine of NT$100,000.
  4. When marketing a Kyoto Tech TR-126P 4-field LCD punch clock on tw.yahoo.com, Yahoo! Taiwan Holdings Limited, Taiwan Branch (H.K.) and OAHome Co., Ltd. advertised the product as “the only 4-field punch clock on the market capable of 2-color printing.” The claim was a false and misleading representation with regard to quality of product and could also affect transaction decisions in violation of Article 21 (1) of the Fair Trade Act. The FTC imposed an administrative fine of NT$50,000 on each company.
  5. When marketing a LAIFU P960 Microcomputer Chinese/Number dual-function check machine on etmall.com, Eastern Home Shopping & Leisure Co., Ltd. and Yi Hsing International Technology Co., Ltd. claimed the product was “the only check machine on the market able to print out Chinese characters and numbers simultaneously.” The wording was a false and misleading representation with regard to quality of product and could also affect transaction decisions in violation of Article 21 (1) of the Fair Trade Act. The FTC imposed administrative fines of NT$100,000 and NT$50,000 on the two companies, respectively.
  6. When marketing the Yuanshan Fujing (transliteration) presale homes, Luxury Construction Co., Ltd. and Haihua (transliteration) Advertising Co., Ltd. advertised the units as “the front row facing a 10-thousand-ping park,” “the first row across from a 20-thousand-ping sea of trees” and “just a 5-minute stroll between the housing project and the future Y25 Shilin District Office Station of the Circular Line.” The wording was a false and misleading representation with regard to content of product and could also affect transaction decisions in violation of Article 21 (1) of the Fair Trade Act. The FTC imposed administrative fines of NT$1 million and NT$500,000 on the two companies, respectively.
  7. Two individuals respectively surnamed Wu and Huang organized a special topic ESG seminar entitled “Coping with the Impact of US Carbon Tax Imposition on Enterprises” and posted in the advertisement the wording “Advisory Units: Environmental Protection Administration and Industrial Development Administration.” The claim was a false and misleading representation with regard to content of service and could also affect transaction decisions in violation of Article 21 (1) of the Fair Trade Act. The FTC imposed an administrative fine of NT$50,000 on each of them.
  8. When marketing a “Shaping Myself fat-burning volcanic energy stone abdomen-reducing and body-shaping silk bodysuit (one piece)” on PChome24h, PChome Inc. and Liann International Enterprise Co., Ltd. posted the wording “fat-burning volcanic energy stone...You only need one piece A+Slim to go from corpulence to slenderness.” The claim was a false and misleading representation with regard to quality of product and could also affect transaction decisions in violation of Article 21 (1) of the Fair Trade Act. The FTC imposed an administrative fine of NT$50,000 on each company.
