1. When marketing the Yongyue Yifang (transliteration) presale home project, Bo-yuan Construction Corp. and Ju Feng Hotel Management Consultant Co., Ltd. requested that homebuyers pay a deposit in order to inspect the presale home purchase contract. The practice illegitimately restricted the right of homebuyers to read the contract in advance and was obviously unfair conduct able to affect trading order in violation of Article 25 of the Fair Trade Act. The FTC imposed administrative fines of NT$5 million and NT$1 million on the two companies, respectively.
2. When New Taipei (translation) Construction Co., Ltd., Hong Pu Real Estate Development Co., Ltd. and Hai Xin (transliteration) International Co., Ltd. marketed the Hong Pu Central Park presale home project, the list of shares held by individual units they provided to homebuyers was incomplete and included insufficient common areas, omissions and errors. However, the companies continued to use erroneous information to make transactions even after discovering the mistakes. The deceptive and obviously unfair conduct was able to affect trading order in violation of Article 25 of the Fair Trade Act. The FTC imposed administrative fines of NT$1.2 million, NT$600,000 and NT$400,000 on the three companies, respectively.
3. Force MOS Technology Co., Ltd. continued to send warning letters to the trading counterparts of competitors to assert its rights even after the company’s patent had become invalid. The practice was in violation of Article 25 of the Fair Trade Act. The FTC ordered the company to cease the unlawful act.
4. The Taipei City Motorcycle Trade Association established suggested wages, suggested charges for motorcycle examination without reparation and a list of prices for pollution improvement and distributed them to members for reference. The practice was in violation of the regulation against concerted actions set forth in Article 15 (1) of the Fair Trade Act. The FTC imposed an administrative fine of NT$100,000 on the association.
5. When marketing the “A+Courbe silk selenite fat-burning traceless abdomen reduction body-shaping pants (paying the price of one pair to get two pairs)” on momo.com, Fubon Multimedia Technology Co., Ltd. and Liann International Enterprise Co., Ltd. posted the claim “selenite burning fat” and “volcanic selenite...unlocking fat, breaking up fat chunks to help you get rid of obesity.” The wording was a false and misleading representation with regard to quality of product and could also affect transaction decisions in violation of Article 21 (1) of the Fair Trade Act. The FTC imposed an administrative fine of NT$50,000 on each company.
6. When marketing NoNiCa chili-added fat-burning compression pants on 24h. pchome.com.tw, PChome Online Inc., Tainan Spinning Retail and Distribution Co., Ltd. and Central-E Expansion Technology Co., Ltd. posted the claim “chili generating heat to penetrate and burn fat” and “chili added to accelerate fat elimination...speed up fat burning to achieve slimming.” However, the wording was groundless and in violation of Article 21 (1) of the Fair Trade Act. The FTC sent a warning letter to remind the three companies to pay attention to related regulations in the Fair Trade Act in order not to break the law.
7. When marketing an electric smart fat-burning waist-thinning belt for dummies on 24h.pchome.com.tw, PChome Online Inc. and Huihong Trading Co., Ltd. posted the claim “burning fat to get thin,” “massaging the arms to say goodbye to flabbiness,” “corseting and massaging the waist to get rid of fat belly and beer gut” and “gently massaging for a few minutes a day to become slim.” The wording was a false and misleading representation with regard to quality of product and could also affect transaction decisions in violation of Article 21 (1) of the Fair Trade Act. The FTC imposed an administrative fine of NT$50,000 on each company.
