    4.Focusing on Key Issues to Repress Marketing through False Advertising
(1) Reinforcing investigations to crack down on false advertising
False advertising has always been a concern in various sectors and a key target of the Commission’s investigation. To control false advertising, the Commission has formulated disposal directions on handling cases involving Article 21 of the Fair Trade Act and has also established administrative rules for handing advertisements presenting endorsements and testimonials, real estate advertisements, comparative advertisements and online advertising to reinforce investigation and sanction different types of false advertising to protect performance competition and safeguard consumer interests.
In light of the increase in false advertisements and the heated real estate market, the Commission executed the Plan for Investigation and Sanctioning of False Real Estate Advertising in the New Era of Digital Convergence in 2023 to step up its investigation of online and real estate advertisements. In addition to using web crawlers in combination with possibly unlawful keywords to examine online advertising, the Commission also looked into topical online advertising that generated heated discussions in the media and subsequent tendencies. At the same time, the Commission also paid visits to housing project sites, launched investigations when finding evidence of illegal activities, and imposed fines on or issued warnings to offenders. Among the false advertising cases in which sanctions were decided, a large number of them were associated with real estate, household appliances and 3C products.
