1. Illegitimate use of names of competitors in keyword advertisements
An informer accused two major international hotel reservation websites, Agoda and Booking.com, of using the informer’s company name to produce keyword advertisements. The FTC’s investigation showed that Agoda used EasyTravel, the name of its competitor 2022 and turned on the keyword insertion function. When an Internet user entered the word EasyTravel on the two platforms, the web page would display the wording “EasyTravel – late of Agoda to form a keyword advertisement. Then the user would be directed to the website of Agoda. Meanwhile, Booking.com also adopted a similar illegal practice from Jul. 2018 to Dec. 2022 to direct Internet users to its website.
The FTC concluded that the practice of Agoda and Booking.com was obviously unfair conduct exploiting the fruits of the work of others in violation of Article 25 of the Fair Trade Act. In addition to ordering Agoda and Booking.com to immediately cease the unlawful act, the FTC
