3. Falsely claiming reserved loan amounts

(hereinafter referred to as Shengxi Construction) posted in an advertisement the wording “reserved loan amounts from Hua Nan Bank” and “Hua Nan Bank trust guarantee” when marketing the Shengmei Garden housing project on the company website in Sep. 2024. False advertising was suspected.
The advertisement gave the impression that people purchasing units of the housing project could obtain reserved loans and trust guarantees from Hua Nan Bank. However, the FTC’s investigation showed that Shengxi Construction had not signed any papers related to reserved loan amounts and trust guarantees with Hua Nan Bank. Therefore, the claim was inconsistent with the fact in violation of Paragraph 1, Article 21 of the Fair Trade Act. The FTC                                trust guarantees were available.
4. Presale home sellers requesting that homebuyers pay a deposit to obtain and read the purchase agreement
When implementing the Plan for Investigation of False Advertising and Real Estate in the Digital Convergence Era, the FTC discovered that Bo Yuan Construction Corp. (hereinafter referred to as Bo Yuan Construction) and Ju Feng Hotel Management Consultant Co., Ltd.               obtain and read the presale home purchase agreement when marketing the Yong Yue Yi Fang housing project.

homebuyers pay a deposit or a certain fee to obtain and read the purchase agreement, the practice will put homebuyers in a disadvantageous position and have an effect on homebuyers’ transaction decision making. At the same time, it can also lead to unfair competition for competitors who provide homebuyers with purchase agreements free of charge according to regulations. After the investigation, the FTC concluded that the practice of Bo Yuan Construction and Ju Feng Consultant was obviously unfair conduct able to affect trading order                  NT$5 million and Ju Feng Consultant NT$1 million.
